1) Having a Will is vital to providing clarity and certainty to your family members.We can assist you with the drafting of a Will that will ensure your property and possessions are gifted to your loved ones and disputes and uncertainty are eliminated.
2) We can also assist with preparing (and defending) claims that may arise with a eligible beneficiary not being recognised under the Will or receiving inadequate provision.
3) We assist with: drawing a Will that reflects your wishes;
-Preparing more complex Wills, where for instance you are making provision for a child with a long term disability such as testamentary trusts;
-Dealing with claims between family members seeking a variation of the Will and preparing a Deed of Family Arrangement;
– Updating Wills and attending to their alteration, either through amending the Will or preparing a codicil;
-Dealing with complex disputes under Part IV of the Administration and Probate Act and making a claim for a beneficiary who has unfairly received minimal entitlement or eliminated entirely;
-Assist with a potential situation where unfortunately no Will has been left and a Letters of Administration application must be lodged.
We also provide an additional service where we can attend a client out of office at their office if due to infirmity or disability they are unable to attend at our office.
On Me / Start:
Philip was admitted to practice in 1984 and commenced legal practice in Frankston, appearing in the local magistrates court in criminal matters and conducting personal injuries claims and family law.
Philip worked for many years as a litigation specialist, particularly in the area of serious personal injuries in TAC and workcover claims, and through the 1990’s conducting spinal injury litigation with many claims in the County and Supreme courts. During the 2000’s he redesigned his legal practice and spent time in both the private and government sectors, recasting himself as a Family lawyer , processing family law and intervention order cases in the Westen suburbs at the Brimbank Melton and St. Kilda Legal Services. Philip is a pragmatic, hard working advocate who is committed to the best outcome for his client.
Throughout all of this Philip has recognised the importance of “telling it as it is”, building respectful relationships and partnerships with his clients and retaining a sense of humour. At the end of the day, Philip and his staff want the law to work for his client, with a commitment to the best outcome. Philip is now based in Frankston, running a general practice with a focus on Business and Commercial law, Probate, Wills and Family Law together with Conveyancing and land transfer work.
